Terms of Service
1. Agreement to Terms
Welcome to GoldSwell™. These Terms of Service ("Terms") govern your access to and use of the GoldSwell™ application, website, and services (collectively, the "Service"), operated by Adventure Hub (PTY) LTD ("we," "us," or "our"), a company registered in Cape Town, South Africa. By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
2. Eligibility
You must be at least 18 years old to use the Service. By using GoldSwell™, you represent and warrant that you have the legal capacity to form a binding contract.
3. Account Registration
To access certain features, you must register for an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Subscription & Payments
GoldSwell™ offers tiered subscription plans. Each tier provides varying levels of access to G-Spot™ monitoring, G-Probe™ analysis reports, real-time alerts, and advanced features such as satellite imagery. • Payments: Payments are processed securely through our third-party providers. On web, payments are handled by LemonSqueezy. On iOS, payments are processed by Apple via In-App Purchase. On Android, payments are processed by Google via Google Play Billing. We do not store your full card details on our servers. • Billing: Subscriptions are billed in advance on a recurring basis. • Taxes: Prices are inclusive of applicable taxes where required by law.
5. User-Generated Content & Profile Data
You may upload a profile photo (avatar), write a bio, post notes, analysis reports, or other content ("User Content"). • You retain ownership of your User Content, including your profile photo and bio. • Profile photos are resized to 512×512 pixels and converted to WebP format for optimal performance. • Your profile photo and bio may be visible to other users as part of your public profile. • You grant GoldSwell™ a worldwide, non-exclusive, royalty-free license to use, store, and display your User Content to provide and improve the Service. • You may delete your profile photo or bio at any time from your profile settings.
6. Prohibited Conduct
You agree not to: • Use the Service for any illegal purpose. • Reverse engineer or attempt to extract the source code of the Service. • Use automated systems (bots, scrapers) to access the Service without authorization. • Interfere with the security or integrity of our geomorphological analysis engine.
7. Disclaimers & Limitation of Liability
• "As Is" Basis: The Service, including environmental and weather data, is provided "as is" for informational purposes only. We do not guarantee the accuracy or reliability of any data. • Safety Warning: GoldSwell™ is NOT a primary navigation or safety tool. Always rely on official authorities and your own judgment for safety at the beach. • Liability: To the maximum extent permitted by law (including the South African Consumer Protection Act), Adventure Hub (PTY) LTD shall not be liable for any injury, loss, or damage arising from your use of the Service.
8. Communications & Messaging
By using GoldSwell™, you may opt in to receive notifications via: • Push Notifications: Real-time alerts for G-Probe™ events and Goldilox Zone conditions. • Email: OTP verification codes, account updates, and periodic reports. • WhatsApp: OTP verification codes, G-Probe™ alerts, and marketing communications (opt-in only). You can manage your notification preferences at any time in your account settings. WhatsApp messages are delivered via the WhatsApp Business API, operated by Meta Platforms, Inc. By opting in to WhatsApp notifications, you consent to receiving messages from GoldSwell™ via this channel. Standard WhatsApp data charges may apply.
9. Termination
We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms.
10. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts in Cape Town.
